This is the last will and testament of me John Scott of Stourbridge in the county of Worcester Victualler First I will and direct that all my just debts funeral and testamentary expences be fully paid and satisfied by my trustees and executors herinafter named Also I give and bequeath unto William Jones of Oldswinford in the said county of Worcester brickmaker George Scott of Stourbridge bricklayer and Peter Bird of the same place joiner their heirs and assigns all my household goods and furniture plate linen china Glass Stock of Ale Liquors Brewing utensils and all other my stock in and implements of Trade upon trust that they the said William Jones George Scott and Peter Bird or the survivor of them shall as soon after my decease as may be taken account of the same household goods and furniture stock in trade and all other my personal estate and effects of what nature or kind soever the same may be and to carry on my said trade for the term of one whole year and after the said term shall have expired and paying all reasonable expenses in carrying on my said trade and maintaining and educating all my children or placing them out apprentices I will and direct my said trustees to take an account of the gain or loss of my said trade during the said term of one whole year and in case there shall be no loss to carry on the same as long as they my said trustees or the survivor of them shall think proper and the increase and produce thereof to be paid and applied towards the payment of what debts may be due and owing after my decease and the overplus if any to be put out at interest on public or private security or securities for the benefit of my children And in case there shall be a loss I will and direct my said trustees if they shall think fit to see and dispose of my said household goods and furniture stock in and implements of trade and all other my personal estate and effects and to pay and apply the produce arising from such sale in payment of my just debts and the overplus if any to be paid and applied towards payment of the mortgage debt to Edward Corser secured by the premises herinafter willed or otherwise place the same out at interest for the benefit of my children as aforesaid Also I give and bequeath unto my said trustees their heirs and assigns all those six tenements or dwelling houses situate in Stourbridge aforesaid four of which said tenements are standing and being in or near a place called the Back Lane in Stourbridge aforesaid and now in the occupation of George Gotheridge Margaret Scott John Worrall and John Luck and the two other tenements or dwelling houses are standing and being in a place called The Gullet and again the above forementioned tenements in the Back Lane aforesaid and are now in the holding of George Watass and John Butler together with all outbuildings and premises to the same belonging or appertaining to hold the same unto the said William Jones George Scott and Peter Bird their heirs and assigns to and for the several uses trusts intents and purposes herein aftermentioned (that is to say) upon trust (after paying the yearly interest which shall accrue due to the said Edward Corser on his mortgage of the above mentioned premises) to pay and apply the rents issues and profits of the same premises towards the maintenance and education of all and every my children until they and each of them shall have attained the age of twenty one years and after they shall have attained the said age I will and direct my said Trustees or the survivor of them to make sale and disposal of the said messuages and premises household goods and furniture stock in and implements of Trade and all my real and personal estate and effects and out of the monies arising therefrom to pay and discharge the said mortgage debt due to the said Edward Corser and also the remaining part of my just debts in any shall remain unpaid And after payment thereof to equally divide the overplus between and among all and every my children that shall be living at the time the youngest of them shall have attained his or her age of twenty one years Also I give and bequeath unto my said trustees the silver table and tea spoons sugar tongs and tea scope together with all the wearing apparel of my late wife Sarah Scott that they my said trustees or the survivor of them shall equally divide the same between my two daughters Lucy and Diana Scott at such time as they my said trustees shall think fit and proper the same to be vested in the hands of one of my said Trustees for safe custody until the same shall be divided as aforesaid Also I give and bequeath unto my said Trustees my own wearing apparel that my said Trustees shall equally divide the same between my two sons Henry and Samuel at such time as they my said Trustees shall think fit and proper the same to be vested in the hands of one of my said Trustees until the same shall be divided as aforesaid Anything herein contained to the contrary notwithstanding and I do hereby nominate constitute and appoint the said William Jones George Scott and Peter Bird joint Executors of this my Will and I do hereby declare not be charged or chargeable with or answerable or accountable for any more monies and effects than they respectively shall actually receive or come to their respective hands on possession by virtue of this my Will nor with or for any loss or losses which shall or may happen to the same or any part or parts thereof so as such loss or losses shall happen without their any or either of their wilful default or neglect nor shall the one of them be answerable or accountable for the others or other of them that each of them for himself and his own acts deeds defaults receipts and disbursements only and also that it shall & may be lawful to and for my said Trustees and Executors and the survivors or survivor of them his Executors and Admors in the first place by and out of the afresaid rents monies and effects to deduct and reimburse themselves and every and each of them and to allow to his co-Trustees and co-Trustee and co-Executors and co-Executor all such sum and sums of money costs charges damages and expences as they any or either of them shall or may sustain pay expend or be put unto for or by reason or means of the Trusts hereby in them reposed or the management or execution of this my Will or any other matter cause or thing in anywise relating thereunto in witness whereof the said John Scott the testator have to this my last will and Testament written upon three sheets of paper to the first two sheets thereof set and to the third and last sheet thereof set any hand and seal this twenty first day of November in the sixtieth year of the reign of our Sovereign Lord George the Third by the Grace of God of the United Kingdom of Great Britain and Ireland King Defender of the Faith and in the year of our Lord One Thousand Eight Hundred and Nineteen.
